Welcome to StickerSwan®! These Terms of Use (“Terms”) govern your use of our website, StickerSwan.com (the “Site”), and any purchases you make through it. By accessing the Site or making a purchase, you agree to be bound by these Terms. Please review them carefully.

We may update or modify these Terms without prior notice. It is your responsibility to review the Terms before each purchase or use of the Site. The date of the latest update can be found in the final section of the Terms. If you do not agree to these Terms, please refrain from making purchases or using the Site.

By accepting these Terms, you confirm that you are 18 years of age or older. If you are under 18 but at least 13 years old, you may use the Site or make a purchase under the supervision of a parent or legal guardian who agrees to these Terms.

We strive to provide complete, accurate, and up-to-date information on the Site. However, there may be occasional inaccuracies, incompleteness, or outdated information. Product descriptions, prices, and availability are subject to change without notice.

Order Acceptance:

After placing an order, you will receive an order confirmation email with your order number, product details, payment information, and delivery details. We reserve the right to cancel an order at any stage of the manufacturing process if it violates our Terms of Use. In such cases, a full refund will be issued.

Once your order is processed, a shipping confirmation email will be sent to you, providing relevant information. We recommend saving these confirmations for future reference when contacting our customer service.

Payment:

We accept the following payment methods:

1. Credit cards and debit cards: We accept Visa, MasterCard, American Express, Diners, Discover, JCB, and Maestro. Your card will be charged once we send you the order confirmation email. All card transactions are securely processed using Adyen, an encrypted online payment gateway. Payment will be debited from your account upon order acceptance by StickerSwan®. By using a credit/debit card, you confirm that you are the authorized cardholder or have explicit permission from the card owner. All card transactions are subject to validation and authorization by the card issuer. If the issuer rejects payment authorization, your order will be canceled. We are not responsible for any charges or penalties imposed by the payment provider due to payment processing for your order.

Delivery Conditions:

We offer various shipping methods to meet your needs, which will be specified during the checkout process.

Please note that a fee of $10 may be charged for uncollected packages returned to us by the shipping company, as well as for packages returned due to incomplete or incorrect customer addresses. This fee covers shipping and handling costs.

While we strive to dispatch orders within 1-3 business days on weekdays, please allow up to 5 business days for order processing. Delivery times provided are estimates and begin from the date of dispatch. These times do not account for potential delays caused by payment authorization or stock availability. If you require expedited delivery, kindly contact us before placing your order to assess the feasibility.

Please be aware that delays may also occur if the uploaded artwork is of low resolution or otherwise unsuitable for printing. We make efforts to communicate efficiently to minimize such delays, but in such cases, we may require new files to proceed with production.

Returns:

You have the right to return your purchase for a refund within 14 days from the date of receiving the product, provided that the product has not been materially used or worn. Custom-made products cannot be returned once production has started.

To initiate a return, please email us at info@stickerswan.com to receive instructions on the return process.

Please note that you are responsible for covering the shipping costs associated with returning the products for a refund.

Defective Products:

If you receive defective products, please notify us immediately by emailing info@stickerswan.com within a reasonable time of detecting the defect. Please contact our customer service before returning any products. For us to process a complaint, the product must be in the same condition as when you received it. If we determine that the products are indeed defective, we will provide a non-defective replacement item as compensation.

Liability:

StickerSwan’s liability to you is limited to these Terms, unless otherwise stipulated by law. Our liability to you for any reason will not exceed the total purchase amount for your order.

Under no circumstances will StickerSwan assume liability for any incidental, consequential, or indirect damages, such as loss of profit or events of force majeure, including war, civil unrest, governmental measures, strikes, natural disasters, epidemics, pandemics, or similar occurrences, which may affect our operations.

Customer Registration:

To fulfill your order, we require the registration, management, and storage of the personal information you provide to us. Our handling of your personal data complies with applicable privacy laws. Please refer to our privacy policy for more information.

Cookies:

We use cookies on the Site to enhance your browsing and purchasing experience. For more details on our use of cookies and how you can control their usage, please refer to our cookie policy.

Inappropriate Content:

We reserve the right to remove any images or text that are illegal, offensive, obscene, racist, religiously offensive, or to refuse printing designs that we find offensive.

Copyright:

By placing an order, you certify that you hold all rights to use, publish, and transmit the data provided, particularly regarding text and image materials.

You, as the customer, are solely responsible for ensuring that the product does not infringe upon anyone else’s intellectual property rights and that the content of the product complies with applicable laws.

You agree not to hold StickerSwan responsible for any claims made by third parties regarding infringement of their rights, particularly copyright, arising from the use of data transmitted by you. This means you will ensure that StickerSwan is not subject to such claims.

You agree to indemnify and hold us, our directors, officers, employees, agents, affiliates, and subsidiaries harmless from any claims, damages, costs, and expenses, including attorney fees, arising from or related to the infringement of third-party rights, especially copyright, resulting from the use of data transmitted by you, including text and image materials.

Content Permission & Restrictions:

Unless otherwise specified, the design of the Site, including software, source code, text, images, and all other content and materials on the Site (collectively, “Content”), are copyrights, trademarks, or other intellectual properties owned, controlled, or licensed by us. The Content is intended for personal, non-commercial use only. No rights or interests in the Content are granted or transferred to you through your use of the Site.

Except as expressly stated herein, you may not reproduce, publish, transmit, distribute, display, modify, create derivative works from, sell, or participate in any sale or exploit the Content or the Site. Misuse of the Content is strictly prohibited and may subject you to liability under applicable laws.

Termination of Account:

By ordering and using the Site, you acknowledge that StickerSwan may, at its sole discretion, terminate your account, remove, and discard any content contributed by you without prior notice.

Registration, Accounts, and Passwords:

You are responsible for protecting the security of any password or username used to access the Site. You are liable for all activity conducted on the Site associated with your username or password. It is your duty to report any lost or stolen password or username to info@stickerswan.com promptly.

If you suspect unauthorized use of your password or account, please notify info@stickerswan.com immediately. We reserve the right to access and disclose any information, including user names and other details, to comply with applicable laws and lawful government requests.

Governing Law and Disputes:

These Terms shall be governed by and construed in accordance with the laws of the United States of America, without giving effect to any conflicts of law principles. Any disputes arising in connection with these Terms shall be subject to the jurisdiction of the courts where StickerSwan’s place of business is located, except in cases where mandatory law provides otherwise.

Severability:

If any part of these Terms is deemed invalid or unenforceable, such determination shall not affect the validity or enforceability of any other provision. The invalid terms and conditions will be replaced with alternative terms that reflect the original commercial intent of these Terms to the extent possible.
